Terms of Service

PLEASE READ THESE TERMS OF USE ("AGREEMENT" OR "TERMS OF USE" or "TERMS OF SERVICE") CAREFULLY BEFORE USING THE SERVICES OFFERED BY ComiComi. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE ComiComi WEBSITE AND ALL RELATED SERVICES.

1. Definitions

"Company" refers to Shanghai Shutan Technology Co., Ltd. (providing technical services under the name ComiComi).
"Site" refers to the ComiComi website, including any related features, content, or applications offered from time to time by the Company.
"Service" refers to the ComiComi website and all related services provided by the Company, including the AI-powered comic and animation production platform.
"User" refers to any individual or entity using the Site or Service.
"Content" refers to any text, images, code, or other material uploaded to or generated by the Site or Service by Users.
"Assets" refers to the results and outputs generated by the AI models provided by the Service.

2. Acceptance of Terms of Use

The Service is offered subject to acceptance without modification of all of these Terms of Use and all other operating rules, policies, and procedures that may be published from time to time in connection with the Services by the Company. The Company may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time.

3. Rules and Conduct

By using the Service, you agree that it is intended solely for the purpose of using an AI assistant to help accomplish creative tasks through our generation pipeline. You acknowledge and agree that when using the Service, you must have the necessary rights and permissions for any content or data you incorporate.

As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Use. You shall not (and shall not permit any third party to) take any action that:

would constitute a violation of any applicable law, rule, or regulation;
infringes upon any intellectual property or other right of any other person or entity;
is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, obscene, offensive, furthering of self-harm, or profane;
creates Assets that exploit or abuse children;
generates or disseminates verifiably false information with the purpose of harming others;
generates illegal or harmful content.

4. User Responsibility and Content Restrictions

You agree not to create any content or perform any actions that are illegal, infringe on the rights of any third party, or violate any applicable law. You are prohibited from uploading personal information, sensitive data, or data involving national security or public interest. The Company reserves the right to remove any content or disable any action that it deems to be in violation of these Terms of Use, at its sole discretion, and without notice. You are solely responsible for any content you create.

4.1 Beta Features

The Company may introduce test or Beta features. Use of Beta features is entirely voluntary and "AS IS". Such features may contain errors or result in data loss. You agree that use is at your own risk.

5. Intellectual Property and Takedowns Policy

The Company utilizes artificial intelligence systems to generate content. Such generation may unintentionally involve copyrighted material or trademarks held by others. We respect rights holders internationally. If you believe your copyright or trademark is being infringed by the Service, please write to hi@comicomi.ai and we will process and investigate your request and take appropriate actions under applicable intellectual property laws.

6. Fees and Payments

The Company may offer paid Services. You may sign up for a subscription that will automatically renew. You can stop using the Service and cancel your subscription at any time. Unless otherwise stated, your subscription fees ("Fees") do not include applicable taxes, which you are responsible for paying. Except as required by law, all payments for subscriptions and top-ups are final and non-refundable.

7. Termination

The Company may terminate your access to all or any part of the Service at any time if you fail to comply with these Terms of Use, which may result in the forfeiture and destruction of all information associated with your account. Any fees paid hereunder are non-refundable.

8. Governing Law and Dispute Resolution

The interpretation of this Agreement and the resolution of disputes shall be governed by the laws of the People's Republic of China. Any dispute arising out of or in connection with this policy shall be submitted to the competent people's court in the place where the defendant is domiciled.

8.1 Class Action Waiver

To the maximum extent permitted by law, you agree that any claims shall be brought solely in your individual capacity and not as a member of any class or representative action.

9. Modification of Terms of Use

At its sole discretion, the Company may modify or replace any of the Terms of Use, or change, suspend, or discontinue the Service at any time by posting a notice on the Site or by sending you an email. Your continued use of the Service following the posting of any changes to the Terms of Use constitutes acceptance of those changes.

10. Licensing and Training

Subject to your compliance with this Agreement:

you are granted a non-exclusive, limited, non-transferable, non-sublicensable, freely revocable license to access and use the Service;
you own all Assets you create with the Services, and we hereby assign to you all rights, title, and interest in and to such Assets for your personal or commercial use.
AI Training: Unless otherwise agreed in writing or specified in your subscription plan, you agree that the Company may use your Content (Inputs and Outputs) to train, improve, and refine our AI models and algorithms.
Non-Uniqueness: Due to the probabilistic nature of AI, your Assets may not be unique and other users may generate similar or identical outputs. You waive any claims against the Company or other users arising from such similarities.

11. AI Generation Disclaimer

ALL USE OF THE SERVICE AND ANY CONTENT IS UNDERTAKEN ENTIRELY AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" AND IS WITHOUT WARRANTY OF ANY KIND.

Nature of Output: The Service uses artificial intelligence to generate content, which is probabilistic by nature. Identical prompts may result in different outputs.
Accuracy and Reliability: The Company does not guarantee the accuracy, completeness, objectivity, or neutrality of the generated content. Generated content does not reflect the views or positions of the Company.
User Audit Responsibility: You are responsible for reviewing and auditing the generated content and assume all risks associated with its use. The Company is not liable for any misleading information, infringement, or loss caused by the generated content.
Content Safety: While we employ technical measures to filter harmful content, AI systems may still produce results that are offensive or inappropriate.

12. Age Requirements

By accessing the Services, you confirm that you're at least 18 years old and meet the minimum age of digital consent in your country. If you are not old enough to consent to our Terms of Use in your country, your parent or guardian must agree to this Agreement on your behalf.

在使用 ComiComi 提供的服务之前，请仔细阅读本《用户服务条款》（或称“使用条款”、“本协议”）。本协议规定了您访问和使用 ComiComi 网站及所有相关服务的具有法律约束力的条款和条件。

1. 术语定义

“公司” 指上海数坦科技有限责任公司（以 ComiComi 名义提供技术服务）。
“网站” 指 ComiComi 网站，包括公司不时提供的任何相关功能、内容或应用程序。
“服务” 指 ComiComi 网站和公司提供的所有相关服务，包括 AI 驱动的动画和漫画生产平台。
“用户” 指任何使用本网站或服务的个人或实体。
“内容” 指用户上传至网站或服务，或由网站或服务生成的任何文本、图像、代码或其他资料。
“资产” 指由服务提供的 AI 模型生成的结果和输出内容。

2. 接受条款

您使用本服务即表示您在不进行任何修改的情况下，接受本《使用条款》以及公司可能不时发布的所有其他操作规则、政策和程序。公司保留随时拒绝向任何人或实体提供服务，以及更改其资格标准的权利。

3. 使用规则与行为规范

您同意，使用本服务仅限于借助 AI 助手协助完成创作等合法的实际任务。您确认并同意，在使用本服务时，您必须对所包含的任何内容或数据拥有必要的权利和权限。

作为使用条件之一，您承诺不会将本服务用于本《使用条款》禁止的任何目的。您不得（也不得允许任何第三方）采取以下任何行为：

违反任何适用的法律、法规或规章；
侵犯任何其他人或实体的任何知识产权或其他权利；
具有威胁性、辱骂性、骚扰性、诽谤性、欺骗性、欺诈性、侵犯他人隐私权、侵权性、淫秽、攻击性或亵渎性；
生成剥削或虐待儿童的资产；
以伤害他人为目的生成或传播可查证的虚假信息；
生成非法或有害内容。

4. 用户责任与内容限制

您同意不生成任何非法、侵犯任何第三方权利或违反任何适用法律的生成内容。禁止用户上传涉及本人或其他主体的个人信息、敏感数据，或涉及国家安全、公共利益的数据。公司保留在自行决定且不事先通知的情况下，移除任何被认为违反这些服务条款的内容的权利。您对您所生成的内容负全部法律责任。

4.1 测试与 Beta 功能

公司可能不时引入测试或 Beta 功能。使用 Beta 功能完全系自愿且按“现状”提供。此类功能可能存有错误或导致数据丢失。您同意自行承担使用 Beta 功能的一切风险。

5. 知识产权与侵权投诉处理

本公司利用人工智能系统生成内容。此类生成可能会无意中涉及他人持有的受版权保护的材料或商标。我们尊重国际及国内权利人的权益。如果您认为本服务侵犯了您的版权或商标权，请发送邮件至 hi@comicomi.ai，我们将依据相关知识产权法律审查并采取相应的处理措施。

6. 费用和付款

公司可能提供付费服务。您可以注册自动续订的订阅服务。您可以随时停止使用服务并取消订阅。除非另有说明，您的订阅费用不包含任何适用的各项税费，您需要自行承担。除非法律另有规定，所有订阅和充值费用一经支付，概不退还。

7. 终止服务

如果您未能遵守本《使用条款》，公司有权随时终止您对全部或部分服务的访问，这可能导致与您账户相关的所有信息被没收和销毁。在本协议下支付的任何费用均不可退还。

8. 适用法律和争议解决

本协议的解释及因本政策产生或与本政策相关的任何争议解决，均受中华人民共和国法律管辖。任何产生于本协议或与本协议相关的争议，均应提交至被告住所地有管辖权的人民法院诉讼解决。

8.1 集体诉讼豁免

在法律允许的最大范围内，您同意任何索赔仅应以个人身份提出，而不作为任何集体或代表诉讼的成员。

9. 条款的修改

公司有权自行决定随时通过在网站上发布通知或向您发送电子邮件的方式，修改或替换任何《使用条款》，或更改、暂停或终止服务。在《使用条款》发生任何变更后，您继续使用本服务即构成对这些变更的接受。

10. 许可、所有权与训练

在您遵守本协议的情况下：

您被授予免版税、非排他性、有限的、不可转让、不可转授许可、可自由撤销的访问和使用该服务的权利；
您拥有使用本服务创建的所有资产（Assets），据此我们将此类资产的所有权利、所有权和权益转让给您，供您个人或商业使用。
模型训练： 除非另有书面约定或您的订阅方案另有规定，您同意公司可以使用您的内容（输入与输出）来训练、优化和提升我们的机器学习模型与算法。
非唯一性： 由于 AI 的概率性特征，您的资产可能不是唯一的，其他用户可能会生成类似或相同的输出。您据此放弃对公司或其他用户因输出内容相似而产生的任何主张。

11. AI 生成内容免责声明

使用本服务及其任何生成内容的风险均由您自行承担。本服务（包括所有内容）按“现状”和“可用”状态提供，不作任何明示或暗示的担保。

生成内容的性质： 本服务利用人工智能技术生成内容，其结果具有概率性和随机性。同一提示词在不同时间可能会产生不同的结果。
准确性与可靠性： 公司不保证生成内容的准确性、完整性、客观性或中立性。生成内容不代表公司的观点或立场。
用户审核义务： 您应当对生成内容进行审核与判断，并自行承担因使用生成内容而产生的全部风险。对于因生成内容引发的任何误导、侵权或损失，公司不承担任何责任。
内容安全性： 虽然我们已采取技术措施过滤非法或违规内容，但人工智能仍可能产生令人不快或不恰当的内容。

12. 年龄要求

访问本服务即表示您确认您已年满 18 岁（或满足您所在国家/地区同意在线服务的最低法定年龄）。如果您在您国家内未达到接受本使用条款的法定年龄，您的父母或监护人必须代表您同意本协议的约束。
